Terms of Service
Effective October 24, 2026
These Terms are an agreement between Aftercomm, LLC (“Aftercomm”, “we”) and the organisation that creates a workspace (“Customer”, “you”). They govern your use of the Aftercomm service, console and website (the “Service”). How we handle personal information is described in our Privacy Policy, and how the platform handles your email in technical detail on our Trust & Security page.
1. Agreeing to these Terms
By creating a workspace or using the Service you accept these Terms on behalf of the organisation named in your workspace, and you confirm that you have authority to do so. If you do not have that authority, or do not agree, do not use the Service.
The Service is provided to businesses and other organisations for their internal compliance purposes. It is not offered to consumers or for personal use.
2. The Service
Aftercomm connects to the Microsoft 365 mailboxes you select, reads messages from their Sent Items through Microsoft’s read-only API, has each message reviewed by an AI model against a policy you control, and alerts the reviewers you nominate to messages the policy flags. Aftercomm never sits in the delivery path: it does not delay, block, or alter any message.
We may improve and change the Service over time. We will not materially reduce its core functionality during a billing period you have already been charged for.
3. Accounts and security
You are responsible for the users you invite, the roles you assign them, and all activity under your workspace. Keep credentials confidential and tell us promptly at info@aftercomm.com if you believe your workspace has been accessed without authorisation.
The workspace owner controls the workspace’s most sensitive settings, including which AI account reviews run on, any AI provider key, and the workspace’s deletion.
4. Your responsibilities when monitoring email
Reviewing employees’ communications is regulated differently across the world. You, not Aftercomm, decide which mailboxes are monitored and why, and you are responsible for doing so lawfully. In particular, you are responsible for:
- having a lawful basis for the monitoring, and giving the notice to (or obtaining the consent of) monitored individuals that applicable law requires;
- meeting any obligation to consult or obtain the agreement of a works council, trade union, or employee representative body before monitoring begins;
- having authority to grant Aftercomm access to your Microsoft 365 tenant, and to connect the mailboxes you select;
- if you choose to use your own Anthropic API key rather than Aftercomm’s Claude account: holding that account, complying with Anthropic’s terms, and paying Anthropic for the usage your reviews generate. Those reviews are performed on your account and under your agreement with Anthropic.
Aftercomm acts on your instructions when it processes this information. Our Data Processing Addendum, available on request from info@aftercomm.com, forms part of these Terms once signed.
5. AI verdicts are advisory
Verdicts, severities, categories and explanations are generated by an AI model and are provided to help your reviewers decide where to look. They may be wrong: the Service can flag messages that are appropriate, and can miss messages that are not. It does not review every channel your organisation uses, and it reviews only the mailboxes you select.
The Service is not legal advice and does not guarantee compliance with any law or policy. Any decision about a person — including any disciplinary or employment action — must be made by a human at your organisation who has considered the circumstances, not on the basis of a verdict alone.
6. Acceptable use
You agree not to:
- use the Service to monitor anyone you are not lawfully entitled to monitor;
- use it to discriminate against, harass, or retaliate against any person, or for any unlawful purpose;
- attempt to access another customer’s data, probe or test the Service’s security except through our disclosure process, or interfere with its operation;
- resell the Service, or copy, reverse-engineer, or build a competing product from it, except where the law expressly allows.
7. Trial, fees and billing
Free trial. New workspaces receive a seven-day free trial, which begins the first time the Service successfully checks one of your mailboxes. No payment card is required to start. If no card is on file when the trial ends, monitoring pauses; your existing data is kept. The trial includes AI usage up to an allowance shown in the console; if a trial reaches it before a card is on file, reviews pause until one is added, and mail sent meanwhile is reviewed then.
Price. The Service costs US$5.00 per monitored mailbox per calendar month, prorated to the days each mailbox was actually monitored.
AI usage. Unless you choose to use your own Anthropic API key, reviews run on Aftercomm’s Claude account and we also charge for their AI usage: the tokens Anthropic reports for each request made for your workspace (including Test drives, and requests whose result could not be used, which Anthropic also charges for), at Anthropic’s published list price for the model used, as in effect when the request was made, without markup. The total for the billing period is rounded to the nearest cent and shown as its own line on your invoice. The console shows the usage by mailbox, the token counts, and the rates applied. Changes to Anthropic’s list prices apply from the date they take effect and are not price changes by us under “Taxes and changes” below; the console always shows the rates in force. If you use your own Anthropic key, AI usage is billed to you by Anthropic, not by us.
Billing in arrears. We invoice monthly, normally on the first day of each month, for the monitoring that took place in the month just ended, and charge the payment card you have saved with our payment processor, Stripe. Saving a card does not itself charge it. Days and AI usage during your free trial are not billed.
Failed payments. If a charge fails, monitoring continues for a seven-day grace period while payment is retried, then pauses until payment succeeds.
Taxes and changes. Fees exclude taxes, which you are responsible for where applicable. We will give at least 30 days’ notice of any price change, and a change applies from the first full billing month after that notice.
Refunds. Because you are billed only for monitoring that has already occurred, fees are non-refundable except where the law requires otherwise or where we have invoiced in error. Contact support@aftercomm.com about any invoice.
8. Your data
“Customer Data” means the information the Service processes on your behalf, including message metadata, AI verdicts, reviewer actions, and the addresses of monitored mailboxes. You own Customer Data. You grant us the rights needed to provide, secure, and support the Service for you, and for no other purpose.
- Message bodies are not stored by us. They are held in memory only for the duration of a review, and fetched again from your tenant if a reviewer opens a flagged message. Attachment contents are never fetched. Anthropic, which performs the review, retains API inputs and outputs only as described in our Privacy Policy.
- No training. We do not use Customer Data to train AI models, and Anthropic’s commercial terms, under which reviews on Aftercomm’s Claude account run, prohibit it from doing so. Anthropic is our sub-processor for those reviews.
- Deletion. A workspace owner can permanently delete the workspace and all Customer Data at any time from Settings. Residual copies in encrypted backups are overwritten within 7 days.
- Aggregate statistics. We may use de-identified, aggregated usage metrics (for example, volumes and error rates) that cannot identify you or any individual, to operate and improve the Service.
If your subscription ends, we keep your workspace data so that it remains readable, until you delete it or ask us to. We will give at least 30 days’ notice before deleting the data of an inactive workspace on our own initiative.
9. Third-party services
The Service depends on Microsoft 365 (where your email lives), Anthropic (whose models perform the review, on Aftercomm’s account or, if you choose, on your own), and Stripe (which processes payments). Your use of Microsoft 365, and of Anthropic through your own key, is governed by your own agreements with those providers. We are not responsible for their availability, and an outage or change on their side may affect the Service.
10. Confidentiality
Each party will protect the other’s non-public information with at least reasonable care, use it only to perform under these Terms, and disclose it only to people who need it for that purpose and are bound to keep it confidential — or where the law compels disclosure, in which case the disclosing party will give notice where it lawfully can.
11. Suspension and termination
You may stop using the Service at any time. Disconnecting Microsoft 365 in Settings stops all access to your mailboxes immediately; deleting the workspace erases your data. You remain responsible for fees for monitoring that occurred before you stopped.
We may suspend the Service for non-payment after the grace period described above, or immediately if we reasonably believe your use breaches these Terms, creates a security risk, or is unlawful. We will tell you why and, where the issue can be fixed, restore the Service once it is. We may terminate these Terms on 30 days’ notice, or immediately for a material breach you have not cured within 15 days of notice.
12. Warranties and disclaimers
We will provide the Service with reasonable skill and care and substantially as described in its documentation.
Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will identify every message that creates risk, or that any message it flags does.
13. Limitation of liability
To the extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, however caused. Each party’s total liability arising out of or relating to these Terms is limited to the greater of the fees you paid us in the twelve months before the event giving rise to the claim, or US$100. These limits do not apply to your payment obligations, to either party’s indemnification obligations, or to liability that cannot be limited by law.
14. Indemnification
You will defend and indemnify Aftercomm against third-party claims arising from your monitoring of individuals in breach of applicable law or of Section 4, or from your breach of Section 6. We will defend and indemnify you against third-party claims that the Service, as we provide it, infringes their intellectual property rights.
15. Changes to these Terms
We may update these Terms. For a material change we will give at least 30 days’ notice by email to your workspace owner and in the console, and the owner will be asked to accept the new version. The date at the top of this page shows when the current version took effect.
16. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Each party consents to the exclusive jurisdiction of the state and federal courts located there. Either party may seek injunctive relief in any competent court to protect its confidential information or intellectual property.
17. General
These Terms, together with any signed Data Processing Addendum or order form, are the entire agreement between us about the Service. If a provision is unenforceable, the rest remains in effect. Neither party may assign these Terms without the other’s consent, except to a successor in a merger or sale of substantially all of its business. Neither party is liable for delay caused by events beyond its reasonable control. Failure to enforce a provision is not a waiver of it.
